By accessing or using the WeSellTours platform ("Service"), operated by Tyga.Cloud Ltd (company number 14643275, registered in England and Wales), you agree to be bound by these Terms of Service ("Terms"). WeSellTours is a division of Tyga.Cloud Ltd. If you do not agree, you must not use the Service.
These Terms apply to all users, including operators, vendors, customers, administrators, and any person granted access to a WeSellTours account.
WeSellTours is a multi-tenant travel booking SaaS platform that enables operators to create branded booking websites and customers to browse and book travel services. Features include, but are not limited to:

To use WeSellTours you must create an account with accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us immediately at dpo@tyga.cloud if you suspect unauthorised access to your account.
WeSellTours offers operator subscription plans billed on a monthly or annual basis. Plan details and pricing are displayed on our website and within the application. By subscribing, you authorise us to charge the applicable fees to your chosen payment method.
All fees are exclusive of VAT and applicable taxes unless stated otherwise. Fees are non-refundable except where required by law or as described in our refund policy.
Platform commission rates vary by plan and are applied to bookings processed through Stripe Connect. Commission details are provided on the pricing page and within operator settings.
We offer a free plan with limited features. Operators on the free plan are subject to a platform commission on each transaction. Upgraded plans may reduce or eliminate platform commission. We may modify free plan terms with reasonable notice.
Customers may create accounts to browse services, place bookings, and track reservations across all storefronts on the platform. Customer accounts are free of charge.
Vendors may be invited by operators to list their services (hotels, tours, vehicles, boats) on operator storefronts. Vendor access is governed by the operator's terms and the vendor's agreement with the operator.

All content, design, code, trademarks, and intellectual property associated with WeSellTours are owned by Tyga.Cloud Ltd or its licensors. You retain ownership of the data and content you upload to the Service. By using WeSellTours, you grant us a limited licence to process your data solely for the purpose of providing the Service.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using WeSellTours, you consent to our data practices as described therein.
WeSellTours integrates with third-party services to provide functionality. These include:
Your use of these integrations is subject to the respective third party's own terms and privacy policies. Tyga.Cloud Ltd is not responsible for the practices or availability of third-party services.
We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where practicable. We shall not be liable for any downtime, data loss, or service disruption caused by factors beyond our reasonable control.
To the maximum extent permitted by law, Tyga.Cloud Ltd's total aggregate liability to you for any claims arising out of or relating to the Service shall not exceed the total fees you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
You agree to indemnify and hold harmless Tyga.Cloud Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or breach of these Terms.
You may cancel your account at any time through the application settings. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we are required to do so by law.
Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our Privacy Policy.
We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
